• Policy D11 : states that proposals for minerals and waste development will be permitted where it has been demonstrated that measures appropriate and proportionate to the scale and nature of the development have been incorporated in its design, construction and operation in relation to: minimising greenhouse gas emissions, waste, water consumption and flood risk; generating/utilising renewable or low carbon energy where practicable; ensuring built or civil engineering elements meet a minimum ‘Very Good’ BREEAM or CEEQUAL standard as appropriate; implementing landscape planting comprising native species; mitigating the impacts arising from mining subsidence/land instability and dewatering activity.

RCBC’s Local Plan (adopted March 2018) sets out the vision and overall development strategy for the Borough and how it will be achieved for the period until 2032. This document provides a suite of planning policies that are relevant to the assessment of the proposals. The key land use policy for the proposed development us Policy LS 4 (‘South Tees Spatial Strategy’). Policy LS 4 includes the Wilton International Site and it aims to support development related to Sirius Minerals’ North Yorkshire Polyhalite project, deliver significant economic growth and job opportunities; support the expansion and projection of the port and improve existing employment areas; give the area an industry and make it attractive for inward investment; and support the existing steel industries and take a lead role in supporting the future generation of former steel sites as part of the South Tees Development Corporation.

Policy SD 1 (‘Sustainable Development’): states that the Council will take a positive approach that reflects the presumptions in favour of sustainable development contained within the NPPF. Policy SD 2 (‘Locational Policy’): seeks to give priority to the development of brownfield land in sustainable locations, providing it is not of high environmental value, the reuse of existing buildings and limiting development in the countryside. Policy SD 3 (‘Development Limits’): states that development within development limits will be supported subject to meeting other policies in the Local Plan. Policy SD 4 (‘General Development Principles’): seeks to promote good design, protect the amenities of occupiers, open space or the environment, Natura 2000 sites, built or heritage assets, agricultural land, protect against flood risk and ensure proposals have adequate infrastructure, services and community facilities to serve the completed development. Policy SD 5 (‘Developer Contributions’): seeks to secure developer contributions in order to fund necessary infrastructure and other community benefits required as a consequence of development. Policy SD 7 (‘Flood and Water Management’): seeks to minimise development in flood risk areas and ensure development proposals are designed to mitigate and adapt to climate change, taking account of flood risk.
