A3.1

Section 38(6) of the Planning and Compulsory Purchase Act 2004 requires that planning application (including county matter minerals applications) are determined in accordance with the Statutory Development Plan unless material considerations indicate otherwise. Given the cross-boundary nature of this application, the Development Plan comprises a combination of North York Moors National Park Authority and Redcar and Cleveland Borough Council policy documents. The relevant statutory Development Plans for the proposals are as follows:

A3.2

North York Moors National Park Authority

• North York Moors Local Plan 2020, including policies map (July 2020); and

• Minerals and Waste Joint Plan (March 2022).

Redcar and Cleveland Borough Council

• Redcar and Cleveland Local Plan (adopted May 2018);

• Redcar and Cleveland Local Plan Policies Map (adopted 2018); and

• Tees Valley Joint Minerals and Waste Development Plan Documents (adopted September 2011).

A3.3

In addition, the following planning policy documents are considered relevant and material in the determination of the planning application:

• The National Planning Policy Framework (‘NPPF’) (December 2025);

• Planning Practice Guidance (‘PPG’); and

• National Design Guidance (‘NDG’) (January 2021).

NYMNPA – North York Moors Local Plan 2020

A3.5

The NYMNPA Local Plan sets out planning policies for the North York Moors National Park that will be used to help deicide planning applications in the future. The plan: • conserves and enhances the National Park’s natural beauty, wildlife and cultural heritage, and protects special areas and features within it from harmful development; • protects and encourages the understanding and enjoyment of the National Park’s ‘Special Qualities’;
